Before using this internet site (the “Site”), please read these conditions (the “Terms”) carefully. Each entry to the Site and/or use of the Site means that you accept the Terms, that you confirm your approval of the Terms and that you declare that you have read them and have understood their contents. Should you not agree to the Terms, please do not use this Site. This Site is owned by British Israel Investments Ltd. and is operated by them and they are permitted to make changes to the Site and to the Terms of Use at any time at their sole discretion. Use of the Site after a change in the Terms shall bear witness to your agreement with the revised Terms.

The Terms are formulated in the masculine gender for reasons of convenience only, but they relate to both sexes equally.

 

Use of the Site

 

British Israel Investments Ltd. and its subsidiaries and associated corporations (jointly: “British”) permit you to view the contents of this Site, including materials, information, data, text, software, music, sound, pictures, video, graphics and any other material that is included in this Site and under this generality are the services provided on the Site (collectively: the “materials”) and to download them for personal and non-commercial use only, provided that you shall act in accordance with all of the notifications concerning the copyright and intellectual property rights included in the original materials and in any copy thereof. You are not authorised to change said materials in any fashion, to copy them, to duplicate them, to distribute them, to sell, to permit use, to present them publicly, to perform them, to publicise them, to create derivatives therefrom, to create a product or output or any material while making use of the materials or to use said materials in another way for any public or commercial purpose without the consent in advance and in writing of an authorised representative of British. The use of the materials on any other internet site or in a computer network for any purpose whatsoever is prohibited. The materials on the Site are protected by copyright, and any unauthorised use thereof, of any of the material that is on the Site, is liable to constitute an offence against the copyright laws, the trademarks laws and other laws. Should you breach one of these Terms, then the permit granted to you to use the Site shall be revoked automatically, and you shall be obligated to immediately destroy any material you have downloaded or printed from the Site. Use of the Site for the purpose of distributing “junk” mail (“unsolicited mail”) is prohibited. No use may be made of the Site’s domain name. No deception, fraud or impersonation of another party may be practiced through the Site.

 

No liability; use of the materials

British has made reasonable endeavours to ascertain that the information on this Site will be accurate and up-to-date, but British is not obligated, nor does it guarantee this, that the Site, the materials and the content found therein is accurate, complete or up-to-date and they shall bear no liability whatsoever for the materials and/or their correctness. The materials are offered “as is”, and according to their availability (“as available”), without any obligation or liability of any kind whatsoever on the part of British. There is nothing in the contents of the Terms that may be considered as a presentation by British concerning suitability for a particular purpose, the reliability or the accuracy of the materials or an absence of a breach of intellectual property rights. British is permitted to make changes to the materials or to part thereof, at any time and without notification. The materials on the Site are liable to be not the most up-to-date and British does not undertake to revise the materials on the Site in general or at any particular frequency. The pictures on the Site are for illustrative purposes only, and are not binding. In addition to this, British does not undertake or guarantee that access and use of the Site is secure or at your disposal without any interference, without breakdown and/or without viruses or other harmful elements. Limitation of liability

 

Under no circumstances shall British, anyone on its behalf or any other third party whatsoever referred to on the Site bear responsibility in respect of any damage (including, but not only, direct, indirect or consequential, those that derive from a loss of profits, from a loss of data or from a disturbance in the course of business) as a result of the use, an inability to use, or from the results of using the Site, or any other site linked to this Site, or the materials included in the Site and in each one of these sites, whatever this may be, and shall not be grounds for a claim or reason for the damage, either contractual, in damages or otherwise, notwithstanding the contents of any law. The only remedy that is granted to you in any event and notwithstanding the contents of any law, is the cessation of use of the Site.

The design and presentation of the Site are protected by the copyright and trademarks of British and the copying thereof, in whole or in part, is prohibited. The copying, duplication, distribution, sale, permission to use, public presentation, performance, publicising, or exploitation of the Site or any part thereof for any commercial purpose including logos, graphics, sounds and pictures from the Site is prohibited, without the permission of British in advance and in writing and subject to the Terms of the permit. You are not permitted to create frames for the Site without the approval of British in advance and in writing and subject to the Terms of the permit. The use of meta-tags or any other concealed text while making use of the name of British or its trademarks is prohibited, without the approval of British in advance and in writing and subject to the Terms of the permit. Any unauthorized use shall cause, inter alia, the termination of your right to use the Site.

Apart from whatever is explicitly permitted by the Terms, British does not grant you any right whatsoever in respect of the intellectual property rights of British or of any third parties whose materials belong to or are associated with them.

 

Information about users

 

British is not interested in obtaining any secret information whatsoever from you through the Site and therefore you are requested not to send to British any secret information through the Site and/or by e-mail. Any material, information or other type of communication (“messages”) that may be broadcast or published on the Site shall be considered as not secret and as having no property rights. You declare that you do not have any expectation as regards confidentiality in respect of anything appertaining to your messages through the Site. British shall not have any liability in connection with messages. British and anyone on their behalf shall be free to copy, to divulge, to distribute, to combine the messages and to make any other use of the messages and of the data, pictures, sounds, text and other elements that are combined in messages for any purpose, either commercial or non-commercial. You are prohibited from publicising on the Site or broadcasting thereto any illegal, threatening material, anything that may be considered as slander, defamation, disgraceful matters or pornography, or any other material that is liable to constitute an offence by any law, and you are also prohibited from using the Site for any illegal purpose whatsoever.

You are not permitted to create links to the Site from other sites, other than with the approval of British in advance and in writing and subject to the Terms of the permit and the provisions of any law.

 

Trademarks

 

Names of corporations and products referred to in the Terms, are the trademarks and/or trade symbols of their respective owners. Nothing in using the Site grants you any rights to the trademarks of British or of any third parties advertising on the Site.

Limitation of access and indemnification

British reserves its right to refuse to grant access to the Site or to parts thereof to any user, at its sole discretion, and without any prior warning. The license to use the Site is dependent on the terms of this agreement being fulfilled. You hereby agree and undertake to protect, to exempt from any claim, to indemnify British, its employees, directors or anyone on its behalf in response of any claim, damage, loss, loss of profits, payment or expense that may be caused them - and under this generality are lawyer’s fees and court costs based on the use that you are making of the Site and/or of the content while breaching this agreement, and you hereby agree not to sue British in respect of the use of the Site. You hereby agree that should you be so requested, you shall desist from entering the Site.

The laws of the State of Israel shall apply to these Terms and to this Site and they shall be interpreted in accordance therewith. The sole place of jurisdiction in regard to anything connected with the Terms and/or the Site is the official courts of law in Tel Aviv-Jaffa. British is administering the Site from its offices in Israel. British is not making any presentation that the materials on the Site are suitable or are available for use outside of the boundaries of Israel. Use of the Site is prohibited in countries that do not grant validity to the Terms included in this document, including, but not only, those countries in which the contents of the Site are illegal. You are not permitted to make use of the materials or any copy or processing thereof, to export them or to re-export them in such a way that shall constitute an offence under any relevant law or regulation. Should you decide to access this Site from outside the boundaries of Israel, you are doing so at your own initiative and at your responsibility, and you shall bear responsibility for compliance with any local laws that may apply. British reserves its right to revise and/or to change the Terms by a revision of this notice at any time, while updating the date of the last revision appearing at the top of this document, so that at any time you may be aware what the up-to-date Terms are. You should visit this Site from time to time to ascertain the revised Terms, that indeed they are the ones that are binding as from the date of their revision onwards. Specific announcements and/or legal conditions found in certain pages of the Site are likely to take precedence over certain conditions included in these Terms. British is permitted to transfer the Terms, and all of the rights and obligations deriving therefrom. The Terms shall apply to and shall bind the parties, their representatives, their heirs, and any other of their authorised representatives. Nothing contained in these Terms prejudices the right of British to fulfil the demands or requests from legally empowered entities in respect of anything appertaining to the use of the Site or of the data that is sent to British or that is collected by British in the context of using the Site. Should it be determined that any part whatsoever of the Terms are not valid, or that they are not enforceable by law, including but without limitation, the liability limiting clauses referred to above, then the clauses that shall no longer be valid or which cannot be enforced, shall be considered as if they have been replaced by valid clauses which can be enforced whose contents match, in the closest possible way, the intention of the original clauses, whereas the other clauses of the Terms shall remain in force. Should British waive, either explicitly or generally, a right granted to it according to the Terms in a particular circumstance, one shall not understand therefrom any equivalent ruling for any other circumstance and this shall not be considered as a waiver of their rights. These Terms constitute the complete and full agreement between the user and British in connection with the Site, and they replace any previous or other communication or proposal, whether in an electronic format, either verbally or in writing, that have passed between the user and British or any person on their behalf in connection with the Site.
